Secret. Crown Advocate still holds that Court would not convict on charge of sedition not affecting us in China and that there are no legal means of de- porting in such cases. I have instructed Consul General to submit correspondence privately to judge for his advice and will telegraph his reply,
In the meantime I do not (? see) how Consul General can deal with men from Japan as objections stated in your telegram No.236 to executive action would apply I presume equally to this case and we might have to contest writ of Habeas Corpus.
It would be far preferable to send men to Hongkong.
